These Terms and Conditions (“Terms”) govern access to and use of the CuentasGo website and services (the “Platform”), including the profile marketplace and interaction between users to share subscriptions and access digital service profiles (streaming, software, and others).
By accessing, registering, or using the Platform, you declare that you have read and accept these Terms. If you do not agree, you should not use CuentasGo.
1. Definitions
- Platform / CuentasGo: the site and associated features (publications, messaging, payments, support, etc.).
- User: any person who browses, registers, or uses the Platform.
- Advertiser/Seller: User who publishes an offer for access to a profile or “place” in a subscription.
- Buyer: User who purchases or contracts access to a published profile.
- Profile/Access: credentials, invitation, link, or any mechanism for accessing a profile in a subscription offered by an Advertiser.
- Content: texts, images, descriptions, conditions, messages, reviews, and any information published by Users.
2. Nature of the service (intermediation)
CuentasGo is not the provider of the underlying digital service (e.g., streaming or software). CuentasGo acts as an intermediation platform to connect Users who offer profiles with Users who wish to access them.
Unless expressly stated, CuentasGo is not a party to the agreement between the Advertiser and the Buyer. We do not guarantee the continuity of the underlying service nor do we assume responsibility for changes, blockages, restrictions, or decisions made by the digital service provider.
3. Eligibility and registration
- Minimum age: the Platform is intended for persons over the age of 18.
- Account: registration may be required to publish or purchase profiles. The User agrees to provide accurate information and keep it up to date.
- Security: the User is responsible for safeguarding their credentials and for all activity carried out from their account.
4. Essential rules of the profile marketplace
4.1. Advertiser requirements
By publishing a profile, the Advertiser declares and guarantees that:
- they have the right to offer the access they publish and that their offer does not violate applicable laws or the rights of third parties;
- the information in the advertisement is accurate and not misleading (conditions, limitations, availability, country, type of access, etc.);
- they will not provide access outside the intended flow if this reduces the system's guarantees.
4.2. Buyer Requirements
The Buyer agrees to:
- use the access in accordance with the conditions of the advertisement and applicable rules;
- not attempt to appropriate the profile or modify credentials without authorization;
- not use the access for illegal or abusive activities.
4.3. Compliance with third-party rules
Many digital services have their own terms of use. It is the responsibility of each User to ensure that their activity (sharing or use of profiles) complies with these terms and applicable regulations. CuentasGo may remove ads or restrict accounts if it detects risks of non-compliance, fraud, or abuse.
5. Payments, fees, and transactions
- Payments within the Platform: when integrated payment is available, the User must use the methods enabled by CuentasGo. Avoiding external payments helps prevent fraud and facilitates dispute resolution.
- Fees/rates: CuentasGo may apply fees per transaction or for additional services. Any applicable costs must be displayed before confirming the transaction.
- Taxes: each User is responsible for their tax obligations arising from their activity.
6. Delivery, incidents, and disputes
- Delivery of access: the Advertiser must deliver access within the advertised time frame and conditions.
- Incidents: if access does not work, is incorrect, or is not delivered, the Buyer must report it as soon as possible through the Platform's support channels.
- Mediation: CuentasGo may intervene as a mediator to review evidence and determine a resolution (e.g., redelivery, cancellation, or refund) when applicable.
7. Refunds
Refunds, if applicable, are governed by the Refund Policy published on the Platform, which forms part of these Terms by reference.
CuentasGo may deny requests when there is reasonable evidence of successful use of access, late claims, or abuse of the system.
8. User Content and Licenses
- The User is responsible for the Content they publish.
- By posting Content, the User grants CuentasGo a non-exclusive, worldwide, free, and transferable license to host, reproduce, distribute, and communicate such Content solely for the purpose of operating, promoting, and improving the Platform.
- CuentasGo may remove or limit Content that violates these Terms, is misleading, illegal, or harmful.
9. Prohibited Conduct
The following are prohibited, among others:
- posting false, misleading, or offers that you cannot fulfill;
- circumventing system payments, requesting external payments, or using the Platform for scams;
- impersonating others, manipulating reviews or reputation;
- sharing malware, malicious links, or attempting to gain unauthorized access to systems or accounts;
- harassment, threats, or abusive communications.
CuentasGo may suspend or cancel accounts if there is reasonable evidence of such conduct.
10. Verification and anti-fraud measures
To protect the community, CuentasGo may request verifications (e.g., proof of ownership or expenditure) or apply technical fraud prevention controls. The processing of associated data is governed by the Privacy Policy.
11. Suspension, cancellation, and removal of ads
CuentasGo may, without prior notice in urgent cases:
- remove ads,
- limit features,
- suspend or cancel accounts,
if it detects non-compliance, risk of fraud, repeated complaints, abusive use, or legal requirements.
12. Disclaimer of warranties
The Platform is offered “as is” and as available. CuentasGo does not guarantee:
- that a profile will meet specific expectations beyond those described by the Advertiser,
- that the underlying digital provider's service will be continuous or remain available,
- the total absence of failures or interruptions.
13. Limitation of Liability
To the fullest extent permitted by law, CuentasGo shall not be liable for:
- indirect damages, loss of profits, loss of data or reputation,
- acts or omissions of Users,
- decisions or restrictions of third-party digital service providers.
Where consumer regulations apply (if applicable), this clause shall be interpreted in accordance with mandatory legal limits.
14. Indemnity
The User agrees to hold CuentasGo harmless from any third-party claims arising from:
- their use of the Platform,
- their Content,
- their breach of these Terms or applicable regulations.
15. Modifications to the Terms
CuentasGo may update these Terms for legal, technical, or operational reasons. Changes will be effective upon publication. Continued use of the Platform implies acceptance of the current version.
16. Applicable law and jurisdiction
These Terms shall be interpreted in accordance with applicable law. If the User acts as a consumer, their inalienable rights under the regulations of their country of residence shall be respected.
